Establishing or opening a business in Canada may generate a valid work permit visa and then support permanent immigration to Canada, if applicable.

If you are not a Canadian or do not have a permanent residency visa in Canada there is a category for foreigners who wish to establish or buy a business in Canada that may generate a work permit visa which afterwards may assist the applicant to permanently immigrate to Canada.

In general, the applicant in this category must demonstrate:

  1. be a sole or majority shareholder (have share control);

  2. that their temporary entry into Canada will result in the creation or retention of employment opportunities for Canadians and permanent residents; and

  3. not having to answer to any senior employee (the applicant cannot be dismissed).

Other requirements are to have: a business plan demonstrating how the applicant will finance the company and create or maintain employment, a financial plan; active management of the business; and employing at least one Canadian or permanent resident.

Generally, this work visa will be valid for 2 years and, if fulfilled other requirements, the applicant may apply for the permanent residence visa through the Express Entry program, to permanently immigrate to Canada.
